- The consultant must return the product(s) to Zoom India Centers.
- Period of return for products is calculated as the number of days from the Invoice Date, to the date of receipt at the Zoom India Centre.
- Condition refers to the condition in which the stock is received back from the Zoom India consultant as a return. The product can be ‘marketable’ or ‘unmarketable’ depending on the condition of the returned stock as assessed by the Returns executive at the Zoom India Centre.
- Payment adjustment of Products returned up till 25th of each month shall be processed in the same month. Total Payment of the returned products will be deducted from the returning Consultant’s account.
- If unsold products return is greater than or equal than 6 in number on a single invoice, 10% handling charges will be deducted.
- The Product Satisfaction Guarantee does not apply to open packs of literature and videos or other sales aids.
- Total returns cannot exceed the quantity appearing on the invoice.
- If products are returned by customers directly to Zoom India , Payment adjustment shall be done from the Consultant’s account & any excess amount paid shall be recoverable from the Consultant.
- Taxes means all States, Central, VAT, GST Taxes levied in India.
- Saleable refers to products that are unopened and sealed.
- Unsaleable are products which have been partially used (30%).
- Excess stock refers to products greater than or equal to six in number.
Trademarks
The trademarks, logos and service marks (“Marks”) displayed on the Site are our property and the property of other parties. Users are prohibited from using any Marks without our written permission or third parties, which may own the Marks. We also own “trade-dress” rights to the look and feel of our website, which cannot be replicated, without our permission.
Submissions of Information’s ideas
Any information or material submitted by you to the Zoom India website (whether through e-mail or otherwise) will be deemed non-proprietary and non-confidential, and may be used by Zoom India without restriction. Notwithstanding the foregoing, all personal data (e.g., name, address and telephone number) provided to Zoom India will be handled in accordance with Zoom India Privacy Policy. Zoom India is always improving its products and services and developing new features. If you have ideas regarding improvements or additions to the Zoom India , we would like to hear them. However, please note that under no circumstances shall any disclosure of any idea, related materials to Zoom India be subject to any obligation of confidentiality or expectation of compensation. By submitting the idea and/or any related material to Zoom India , you are waiving any/all rights that you may have in the idea or any related materials and are representing and warranting to Zoom India that the idea and/or related materials are wholly original with you and that no one else has any rights in the idea and/or materials and that Zoom India is free to implement that idea and to use the materials if it so desires as provided or as modified by Zoom India , without obtaining permission or license from any third party.

Termination and Enforcement
This Agreement is effective until terminated by Zoom India . You agree that Zoom India , at its sole discretion, may terminate your access to or use of the ZOOM INDIA WEBSITES, at any time and for any reason, including without limitation if Zoom India believes that you have violated or acted inconsistently with the letter or spirit of this Agreement (including but not limited to your failure to comply with the Code of conduct set forth in Section 6 above). Upon any such termination, your right to use the ZOOM INDIA WEBSITES will immediately cease. You agree that any termination of your access to or use of the ZOOM INDIA WEBSITES may be effected without prior notice and that Zoom India may immediately deactivate or delete any user name and/or password used by or provided by us, and all related information and files associated therewith, and/or bar any further access to such information or files. You agree that Zoom India shall not be liable to you or any third party for any termination of your access to the ZOOM INDIA WEBSITES or to any such information or files, and shall not be required to make such information or files available to you after any such termination. Zoom India reserves the right to take steps that Zoom India believes are necessary or appropriate to enforce and/or verify compliance with this Agreement (including without limitation in connection with any legal process relating to your use of the ZOOM INDIA WEBSITES and/or a third party claim that your use of the ZOOM INDIA WEBSITES is unlawful or violates such third party’s rights). Please note….That the Zoom India Member, during the use of this agreement shall not carry on a similar business, whether independently or in association with others, directly or indirectly and any violation of this ground will automatically lead to termination of this Agreement by Zoom India in addition to the Zoom India Member rendering himself liable to prosecution under the applicable civil & criminal laws. That the Zoom India Member shall not indulge in any anti-company activities in any manner (Any lawsuit or bad propaganda against Zoom India ) and any violation of this ground will lead to immediate termination of this Agreement by the company. That the Zoom India Member will submit a detailed report of the activities undertaken by him/her in order to promote Zoom India business in any time period on being asked by the company. Failure to submit the same will lead to the termination of his/her Membership contract with the company along with lapse of commission / incentives being made thereof.
Jurisdictional Issues
This agreement shall be governed by, construed and enforced solely in accordance with the laws of the India and the courts at Rampur Uttar Pradesh shall have exclusive jurisdiction in this regard. This is the entire agreement between the parties relating to the matters contained herein.
Other
If any provision of this agreement shall be unlawful, void, or for any reason unenforceable then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. We may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.
